Acceptable Use Policy

1. Purpose
This Acceptable Use Policy ("Policy") sets out the rules and standards that govern how you may use the EsterRx platform ("Platform"), operated by Glaxier AUNZ Pty Ltd (ABN: 93 652 028 745) trading as EsterRx ("we", "us", "our").
This Policy applies to all users of the Platform, including registered account holders and patients who submit information via the Platform.
This Policy is incorporated into and forms part of our Terms & Conditions. Capitalised terms not defined here have the meanings given in the Terms & Conditions.
By using the Platform, you agree to comply with this Policy.
2. Nature of the Platform
The Platform is a workflow facilitation tool designed to assist healthcare professionals in managing medication scripting, audit, and inventory processes. The Platform does not provide medical advice, clinical recommendations, or healthcare services of any kind.
We are not a healthcare provider, a prescriber, or a participant in any clinical decision. We do not:
- verify, endorse, or take responsibility for the clinical decisions, prescriptions, or medication selections made by any user of the Platform;
- guarantee that any practitioner using the Platform holds current or valid professional registration, qualifications, or insurance;
- monitor, supervise, or audit the clinical conduct of any healthcare professional using the Platform; or
- accept responsibility for the accuracy, completeness, or clinical appropriateness of any information entered into the Platform by any user.
Each healthcare professional using the Platform is solely responsible for maintaining their own professional registration, practising within their scope of practice, complying with all applicable laws and professional standards, and ensuring the accuracy and appropriateness of any clinical information they enter or approve through the Platform.
To the maximum extent permitted by law, we disclaim all liability for any loss, damage, claim, or expense arising from or connected with clinical decisions, prescribing outcomes, patient treatment, or regulatory non-compliance by any Platform user.
3. Permitted Use
The Platform is designed exclusively for legitimate medication scripting, audit, and inventory management purposes in connection with the operation of a registered healthcare clinic in Australia.
Permitted uses include:
- creating and managing patient questionnaire links and reviewing responses;
- building, reviewing, approving, and managing medication scripts;
- managing clinic settings, team members, and medication configurations;
- recording and managing medication inventory, usage, and audit records;
- patients submitting medical questionnaires in response to an invitation from a clinic; and
- any other use that is consistent with the Platform's intended purpose as described in the Terms & Conditions.
You may only use the Platform for the role(s) assigned to your account and in accordance with applicable Australian law and professional standards.
4. Prohibited Conduct
You must not use the Platform to:
4.1 Clinical misuse
- create, approve, or submit a medication script for a patient who has not provided informed consent;
- approve a script without conducting a genuine clinical review of the patient's information;
- enter false, inaccurate, or misleading clinical information;
- create scripts for medications outside your scope of clinical practice or prescribing authority;
- use another user's credentials or electronic signature to create or approve scripts; or
- represent yourself as a qualified healthcare professional when you are not.
4.2 Audit and record tampering
- attempt to alter, delete, backdate, or otherwise tamper with any audit record, usage log, stock audit, or inventory record stored on the Platform;
- enter false or misleading information into the audit or inventory modules;
- attempt to circumvent the immutability or integrity controls applied to audit and compliance records; or
- destroy or conceal records that are required to be maintained under applicable law or regulation.
4.3 Data misuse
- access, copy, export, or otherwise extract patient data or script data outside the Platform except where expressly permitted by applicable law and with the relevant patient's consent;
- share patient data with any person who is not authorised to access that data under the Platform's access controls;
- use patient data for any purpose other than the provision of healthcare services;
- attempt to decrypt, de-anonymise, or re-identify data that has been de-identified or encrypted; or
- use data collected through the Platform for any commercial purpose unrelated to clinical services.
4.4 System and security misuse
- attempt to gain unauthorised access to any account, system, data, or network connected to the Platform;
- probe, scan, or test the vulnerability of the Platform or any related system;
- introduce or distribute malware, viruses, or other malicious code;
- interfere with, disrupt, or degrade the performance of the Platform or its infrastructure;
- use automated tools, bots, scrapers, or scripts to access the Platform in a manner inconsistent with normal use;
- circumvent or attempt to bypass any access controls, security measures, or technical restrictions; or
- attempt to reverse-engineer, decompile, or disassemble any part of the Platform.
4.5 Unlawful and fraudulent conduct
- use the Platform for any purpose that violates applicable Australian law, including laws governing healthcare, prescribing, and privacy;
- impersonate any person, organisation, or regulatory body;
- submit false professional credentials;
- use the Platform to commit or facilitate fraud or any other criminal activity; or
- use the Platform in a way that infringes the intellectual property rights of any third party.
4.6 Abuse and harassment
- harass, threaten, intimidate, or abuse any other Platform user or member of our team;
- upload or transmit content that is defamatory, discriminatory, offensive, or unlawful; or
- use the Platform to send unsolicited commercial communications.
5. Professional Standards
5.1 Healthcare professionals
Nurses and Doctors using the Platform must at all times:
- maintain valid professional registration with the Australian Health Practitioner Regulation Agency (AHPRA) or the relevant professional body for their discipline;
- practise within their approved scope of practice;
- comply with the professional standards, codes of conduct, and guidelines issued by their professional body;
- comply with applicable Commonwealth, state, and territory laws governing prescribing, supply, and administration of medications; and
- ensure that their professional details recorded on the Platform are accurate and current at all times.
We may, but are not obliged to, verify the professional credentials of any user. Verification by us (where conducted) does not relieve any user of their personal obligation to maintain valid registration and to practise lawfully.
5.2 Clinic Managers
Clinic Managers are responsible for ensuring that all members of their clinic comply with this Policy and applicable professional standards. Clinic Managers must:
- only invite appropriately credentialled and registered healthcare professionals to fill clinical roles within their clinic; and
- ensure their clinic's settings and configurations are appropriate and reviewed regularly.
6. Data Handling Obligations
In addition to the prohibitions in Section 4, all users who access patient data through the Platform must:
- handle all patient information with the strictest confidentiality;
- only access patient data that is relevant to their role and within their clinic;
- not store copies of patient data outside the Platform on personal devices or unsecured systems;
- report any suspected data breach, unauthorised access, or loss of data to us immediately at support@esterrx.com; and
- comply with all applicable privacy and health records laws, including the Privacy Act 1988 (Cth) and relevant state and territory health records legislation.
7. Reporting Violations
If you become aware of any conduct on the Platform that you believe violates this Policy, please report it to us immediately at support@esterrx.com with the subject line: Acceptable Use Policy Report.
Please include as much detail as possible, including the nature of the conduct, the features involved, and any relevant dates or details. We will investigate all reports and respond as appropriate.
We will treat all reports confidentially to the extent permitted by law.
8. Enforcement
We take breaches of this Policy seriously. Upon becoming aware of a potential violation, we may take any or all of the following actions at our sole discretion:
- Warning — issue a formal written warning;
- Temporary suspension — suspend your account pending investigation;
- Feature restriction — restrict your access to specific Platform features;
- Permanent termination — permanently close your account and revoke all access; and/or
- Regulatory reporting — report the conduct to relevant regulatory bodies (including AHPRA, state health departments, the OAIC, or law enforcement) where required by law or where we consider it appropriate.
The above is indicative. We reserve the right to skip steps or act immediately where the severity of the breach warrants it — for example, where patient safety is at risk or criminal conduct is suspected.
9. Consequences of Termination
Where your account is terminated for breach of this Policy:
- all access to the Platform will be immediately revoked;
- data associated with your account may be retained for legal and compliance purposes as described in our Privacy Policy;
- no refund of subscription fees will be provided; and
- you may be liable for damages or legal action arising from your breach.
We may also report breaches to the relevant professional registration body where the breach involves conduct that is inconsistent with the user's professional obligations.
10. Changes to This Policy
We may update this Policy from time to time. We will notify you of material changes by email and/or by displaying a notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Policy.
11. Governing Law
This Policy is governed by the laws of Queensland, Australia. Any dispute arising under or in connection with this Policy is subject to the exclusive jurisdiction of the courts of Queensland.
12. Severability
If any provision of this Policy is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
